DID YOU KNOW...

It is unlawful for your boss to interfere with, restrain, or threaten you in order to keep you from seeking to organize or join a union. Any of the acts listed on this handout constitutes a violation of federal law under the National Labor Relations Act.


YOUR BOSS CANNOT...

  • Attend any union meeting, or park across the street from the Teamsters Local or any union meeting location to spy on you to see if you’re involved in union activity.

  • Engage in any undercover activity which would indicate to you or your fellow workers that you are being kept under surveillance to determine who is and who is not participating in union activity.

  • Tell you that you will be fired or punished if you engage in union activity.

  • Lay you off, discharge you or discipline you for union activity.

  • Grant you or your fellow workers wage increases, special concessions or benefits in order to keep the Teamsters out.

  • Ask you about union matters, meetings, rallies, events, etc.

  • Ask you what you think about your union or a union representative.

  • Ask you how you intend to vote.

  • Threaten you with reprisal for participating in union activities, such as threatening to move the plant, close the business, curtail operations or reduce your benefits.

  • Promise you benefits if you vote against your union.

  • Give financial support or other assistance to a union.

  • Tell you that the company will not deal with your union.

  • Threaten to close, or in fact close or move the plant in order to avoid dealing with your union.

  • Ask you whether or not you belong to a union or have signed up for union representation.

  • Ask you, during the hiring interview, about your affiliation with a labor organization or how you feel about unions.

  • Make anti-union statements or act in a way that might show preference for a non-union person.

  • Make distinctions between union and non-union workers when assigning overtime work or desirable work.

  • Purposely team up non-union people and keep them apart from your fellow workers who support your union.

  • Transfer workers on the basis of union affiliations or activities.

  • Choose workers to be laid off in order to weaken your union’s strength or discourage membership in your union.

  • Discriminate against union people when disciplining employees.

  • By nature of work assignments, create conditions intended to get rid of a worker because of that person’s union activity.

  • Fail to grant a scheduled benefit or wage increase because of union activity.

  • Deviate from company policy for the purpose of getting rid of a union supporter.

  • Take action that adversely affects your job or pay rate because of union activity.

  • Take action that adversely affects your job or pay rate because of union activity.

  • Threaten you through a third party.

  • Promise you a reward or a future benefit if you decide to vote against your union.

  • Tell you that overtime work (and premium pay) will be discontinued if the plant is unionized.

  • Tell you that voting for your union will force the company to lay off workers.

  • Tell you that voting for your union will do away with vacations or other benefits and privileges presently in effect.

  • Promise you promotions, raises or other benefits if you get out of your union or refrain from joining your union.

  • Start a petition or circular against your union or encourage or take part in its circulation.

  • Urge you to try to convince other workers to oppose your union or keep out of it.

  • Visit the homes of workers to urge them to reject your union.


Any of these actions constitutes a violation of the law. If your boss does any of these things, make a note of it, including names of those involved, the date, time and place. Report such incidents to Teamsters Local 89.
